Application file for urban housing construction license

1. Application form for construction license. In case of applying for temporary time construction license, the construction license application must include a pledge for self-demolishing the work when the State implements site clearance.

2. Notarized copies of one of the papers about land use right according to the regulation of the Land Law.

3. The designer’s plan representing the site location, the typical cut and vertical surface; the surface of the foundation; the plan of the position or the route of the work; the plan of the system and the technical joining points of electricity supply, water supply, drainage; photographs of the current situations (for the repair, improvement works there should be construction licenses).

The right to grant construction license

1. The provincial people’s committee authorizes the Director of the Department of Construction to grant construction licenses to the construction works of special grades, grade 1 according to the grade division of works defined in the Decree on construction work quality management; religious works, historical relics – cultural works; monument works, advertisements, imposing pictures in the administrative border line; the works on the routes, axes of urban major roads regulated by the people’s committee of that province.

2. The district people’s committee grants the construction licenses to the remaining works and private urban residential houses in the administrative border line managed by the district, except the works regulated in Item 1 of this Article.

3. The commune people’s committee grants construction licenses to private residential houses in rural residential centers whose construction planning has been approved in the administrative border line managed by the commune as regulated by the district people’s committee.

Construction license extensions

1. Within 12 months after being granted with construction licenses, the applicants of those works which have not been started must apply for their construction license extension.

2. The application file for the construction license extension should include:

· Application form for the construction license extension;

· The original copy of the granted construction license.

3. Construction license extension application shall be processed within 5 working days after the reception of the valid files.

4. The construction license granting agencies are also the ones which extend the construction license.
